In the following, we inform you about the processing of your personal data by PowerCo SE in connection with your visit to one of our social media pages. The operator of the respective social media platform is solely responsible for the processing of personal data on the social media platform itself on which we operate our social media pages (further information on the processing of your personal data by the operator of the respective social media platform can be found in Section B under Section II).

2. Processing of your personal data

2.1 Processing of your personal data by PowerCo SE

When you visit a PowerCo SE social media page, we, as the operator of the social media page, process your actions and interactions with our social media page (e.g. the content of your messages, inquiries, posts or comments that you send to us or leave on our social media pages or when you like or share our posts) as well as your publicly visible profile data (e.g. your name and profile picture). Which personal data from your profile is publicly visible depends on your profile settings, which you can adjust yourself in your settings on the social media platform (further information on this can be found in this section under section 2.3). In general, please ensure that you do not transmit or share any sensitive data or confidential information (e.g. application documents, bank or payment details) via social media platforms; we recommend that you use a more secure means of transmission (e.g. letter post, email). We operate our social media pages and process the aforementioned data for the purpose of providing information about us and our products and communicating with our followers and interested parties and, if necessary, for the purpose of responding to your messages, inquiries, contributions or comments that you send to us (Art. 6 para. 1 lit. b GDPR; legitimate interest: Public relations, company presentation).

The social media platforms also provide us with anonymous usage statistics (so-called analysis services or page insights data) of our social media pages based on the actions and interactions of our followers (e.g. likes, shares, comments, etc.), This data helps us to get in touch with our followers and interested parties, to understand the use and reach of our posts, to evaluate content and recognize usage preferences and to design our social media pages to be as target group-oriented as possible. We have no influence on or access to the creation and processing of these usage statistics and the underlying data; it is carried out under the responsibility of the operator of the respective social media platform and without us being able to view the personal data of individual followers or users (for more information, please refer to section2.3). This data processing is based on our legitimate interest (Art. 6 para. 1 lit. f GDPR; legitimate interest: Optimization of posts on our Facebook company profile, improvement of communication with guests, customers and interested parties).

If, in exceptional cases, we were to carry out a so-called extended comparison with customer lists to be uploaded by us to the respective social media platform as part of interest-based advertising, this would only be done on the basis of your consent (Art. 6 para. 1 lit. a GDPR).

We process your personal data for as long as is necessary for the aforementioned purposes, i.e. generally for the duration of our social media presence. In the event of an objection to processing based on our legitimate interests (Art. 6 para. 1 lit. f GDPR), we delete personal data unless further processing is permitted under the relevant statutory provisions. We also erase personal data if we are obliged to do so for other legal reasons. Applying these general principles, we generally erase personal data immediately after the legal basis ceases to apply if it is no longer required for the stated purposes or the stated purposes cease to apply and provided there is no other legal basis (e.g. retention periods under commercial and tax law), otherwise after the other legal basis ceases to apply.

2.2 Processing of your personal data by the operator of the respective social media platform

The operator of the respective social media platform is solely responsible for the processing of personal data on the social media platform itself on which we operate our social media pages. The operator generally processes your personal data when you visit one of our social media pages, regardless of whether you have a user account on the respective social media platform or are logged in to the respective social media platform, and generally also uses cookies and other storage and (sometimes cross-device) tracking technologies. Further information on the processing of your personal data by the operator of the respective social media platform, which the operator carries out under its own responsibility, can be found in the information on data protection on the following websites of the respective social media platform:

  • Facebook processes your personal data on Facebook for the purposes and on the basis of the legal bases set out in the Meta Privacy Policy.
  • Instagram processes your personal data on Instagram for the purposes and on the basis of the legal bases set out in the Meta Privacy Policy.
  • LinkedIn processes your personal data on LinkedIn for the purposes and on the basis of the legal bases set out in the LinkedIn Privacy Policy.
  • Kununu processes your personal data on LinkedIn for the purposes and on the basis of the legal bases set out in the XING Privacy Policy.
  • XING processes your personal data on LinkedIn for the purposes and on the basis of the legal bases set out in the XING Privacy Policy.
  • YouTube processes your personal data on YouTube for the purposes and on the basis of the legal bases set out in Google's privacy policy.

In particular, we would like to point out that

  • the aforementioned services can assign your activities on our respective company profile to your social media profile if you are logged in to the service and also use it for your own business purposes in accordance with the respective data policy or privacy policy. You can only avoid this if you are logged out and visit our respective company profile in the private mode of your browser or contact us via other communication channels.
  • User data may also be transmitted by the aforementioned services to servers in a third country and thus processed outside the European Union (EU) or the European Economic Area (EEA). The aforementioned companies use standard contractual clauses for this purpose or rely on the adequacy decisions issued by the European Commission with regard to certain countries. Please note that access to your personal data by third parties - such as security authorities, law enforcement authorities, secret services - in the third country cannot be ruled out and that there is no level of data protection in the third country comparable to the GDPR, so that you cannot exercise your data protection rights under the GDPR or cannot exercise them to the extent provided for in the GDPR.

3. Transfer of personal data to third countries

PowerCo SE also transfers your personal data [for the purpose of the above-mentioned data processing] to recipients [possibly processors] based outside the EU/EEA. To ensure an adequate level of protection for your personal data, PowerCo SE concludes EU standard contractual clauses with these recipients. In addition, further protective measures (e.g. encryption and additional contractual provisions) are taken to ensure an adequate level of protection for your personal data, to the extent required by applicable data protection laws.

4. Recipients of your personal data

As part of the provision of our social media pages, we work with service providers (e.g. IT service providers or advertising and content agencies as well as personnel consultancies that support us in the creation of our posts as well as the provision and optimization of our social media page and our recruiting). Insofar as these service providers process personal data on our behalf, we have concluded an order processing contract with these service providers and agreed appropriate guarantees to safeguard the protection of personal data. We also select our service providers carefully, they process personal data exclusively for the performance of their tasks and are contractually bound by our instructions, have suitable technical and organizational measures in place to protect personal data and are regularly monitored by us. We only transfer your personal data to third parties, e.g. service partners or importers, financing service providers, transport service providers, cooperation partners, legal advisors, etc., if you have given us your consent or if this is absolutely necessary to fulfill a contract with you or to protect our legitimate interests (Art. 6 para. 1 lit. a, b and/or f GDPR). Furthermore, we transmit your personal data to public bodies, such as authorities (e.g. tax authorities), if and insofar as this is required by law, as well as to courts in the event of legal disputes.

5. Your rights

You are entitled to the following rights:

5.1 Right to information

You have the right to receive information from us (Art. 15 GDPR) about the processing of your personal data and a copy of the personal data that is the subject of the processing.

5.2 Right of rectification

You have the right to obtain from us the rectification (Art. 16 GDPR) of inaccurate or incomplete personal data concerning you.

5.3 Right to erasure

You have the right to request the erasure of your data if the conditions set out in Art. 17 GDPR are met. Accordingly, you can, for example, request the erasure of your data if it is no longer necessary for the purposes for which it was collected. You can also request erasure if we process your data on the basis of your consent and you have withdrawn this consent.

5.4 Right to restriction of processing

You have the right to request the restriction of the processing of your data if the requirements of Art. 18 GDPR are met. This is the case, for example, if you dispute the accuracy of your data. You can then request the restriction of processing for the duration of the verification of the accuracy of the data.

5.5 Right of objection

If the processing is based on an overriding legitimate interest, you have the right under Art. 21 GDPR to object to the processing of your data on grounds relating to your particular situation. The right to object exists if the processing is either in the public interest or based on a legitimate interest of PowerCo or a third party. In the event of an objection, we ask you to inform us of your reasons for objecting to the data processing. You also have the right to object to data processing for direct marketing purposes. This also applies to profiling insofar as it is related to direct advertising.

5.6 Right to data portability

If the data processing is based on consent or fulfillment of a contract and is also carried out using automated processing, you have the right to receive your data in a structured, common and machine-readable format and to transmit it to another data processor or have it transmitted by us, insofar as this is technically feasible (Art. 20 GDPR).

5.7 Right to withdraw consent under data protection law

Of course, you can revoke your consent at any time without giving reasons to PowerCo by e-mail to careers@powerco.de or under the contact details given in the imprint with effect for the future (Art. 7 GDPR). Alternatively, you can also exercise your consent by making the appropriate settings, provided we have made the corresponding functionalities available. Your revocation does not affect the legality of the processing of your data carried out on the basis of your consent until revocation.

5.8 Right to lodge a complaint

You can also complain to a supervisory authority (e.g. the State Commissioner for Data Protection of Lower Saxony) about our processing of your data.

With regard to data processing by PowerCo SE, you can assert your aforementioned rights against PowerCo SE at any time free of charge. With regard to data processing by the operator of the respective social media platform, you can assert your aforementioned rights against the respective operator at any time free of charge. Further information on exercising your rights can be found in the following section 6.

The primary contact for exercising your rights is the operator of the respective social media platform, who alone has the direct access to the required information or the functionality of the respective platform and can take appropriate measures immediately. Insofar as the support of PowerCo SE is possible or necessary, we will of course support you and, for example, forward your request to exercise your rights vis-à-vis the operator of the respective social media platform.
